Contractual Arrangements applicable to creators: law and practice of selected member states

Project summary

The study, commissioned by the European Parliament, reviewed the legal frameworks and practices of author contracts in eight EU Member States (Belgium, France, Germany, Hungary, Poland, Spain, Sweden, UK). It focused on identifying unfair practices, ensuring fair remuneration, and proposing measures to adapt contracts to evolving digital exploitation environments. Recommendations included monitoring obligations, unwaivability of remuneration rights, reversion rights, and provisions for unknown forms of exploitation.

KEA conducted project management, desk research, email surveys, semi-structured and face-to-face interviews with authors and exploiters, in-depth legal analysis, drafting the report and policy recommendations, and presenting findings to the European Parliament.
